Terms of Use

1. Agreement

These Terms are between you and TypeWriter Education LLC, an Illinois limited liability company ("TypeWriter," "we," "us"). By creating an account or using TypeWriter you agree to them.

If your school or district has signed a separate agreement with us — a services agreement, a data privacy agreement, an NDPA, or a state addendum — that agreement controls where it conflicts with these Terms.

Our Privacy Policy explains how we handle data and is part of these Terms.

2. Who may use TypeWriter

  • Teacher and administrator accounts are for educators, and are created by invitation only. There is no public self-signup. You must be 18 or older and authorized by your school to use a classroom tool.
  • Student accounts are created when a teacher assigns a class code. Students sign in with that code and a password they choose. Students are not asked for, and must not enter, personal information.
  • You are responsible for activity under your account and for keeping your password confidential. Tell us promptly at hello@typewriter.education if you believe an account has been compromised.

3. Your content stays yours

You own what you create. Assessments, questions, rubrics, materials, and feedback you write in TypeWriter remain yours. Student work belongs to the student and the school, as the school's policies provide.

To run the service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, display, and transmit your content solely to operate and support TypeWriter for you. That licence ends when you delete the content or your account, except for copies in routine backups until they age out.

We claim no ownership of your content and we will not use it to train any model, sell it, or show it to anyone you have not shared it with.

3.1 The teacher community

TypeWriter includes an optional community repository where a teacher may publish an assessment for other teachers to browse and copy, and a teacher discussion forum.

Publishing to the community is voluntary and is a separate, deliberate act. When you publish an assessment to the community:

  • You grant other TypeWriter teachers a perpetual, worldwide, royalty-free licence to view, copy, adapt, and use it for their own classroom teaching.
  • You grant us the licence needed to host and display it for that purpose.
  • This licence survives your deleting the post or your account, because other teachers may already have copied it into their own materials. Withdrawing a post removes it from the repository going forward; it cannot recall copies already made.
  • Community posts are not attributed to you by name. Forum posts are attributed.

Only publish material you have the right to publish. Do not publish copyrighted passages, published test items, or licensed content you do not have permission to redistribute, and never publish student work or anything identifying a student.

We may remove community or forum content that violates these Terms, without notice.

4. Acceptable use

Do not:

  • Upload or publish content you do not have the right to use, including copyrighted or licensed material you lack permission to share
  • Enter a student's name, email address, or any other personal identifier anywhere in TypeWriter, including in class names, assessment content, inline comments, or feedback. Students are identified by the class code TypeWriter generates, and the map from a code to a child belongs in your own gradebook. This is the single most important obligation in these Terms: the product's entire privacy posture, and every representation we make to your district, depends on it
  • Instruct or permit students to enter personal details about themselves or anyone else into a response
  • Put other student personal information into TypeWriter — the product is designed so you never need to
  • Attempt to access another teacher's classes, another student's work, or any account that is not yours
  • Probe, scan, or attempt to defeat the security or test-integrity features except with our written permission
  • Use TypeWriter to harass, defame, or harm anyone
  • Scrape, resell, or redistribute the service or the community repository in bulk
  • Use TypeWriter to make an automated decision of legal or similarly significant effect about a student

5. What TypeWriter does and does not promise about test security

This matters, so it is stated plainly.

TypeWriter's secure-test features — fullscreen enforcement, PIN gating, leave-detection, timers, and the activity log — are deterrents that operate inside a web browser. They raise the effort required to cheat and they create a record of what happened.

A web browser cannot lock down a device. TypeWriter cannot prevent a student from using a second device, a phone, or another person. Genuine device lockdown must be enforced by the school at the device or network level.

You are responsible for your own academic-integrity decisions. Do not treat the activity log as proof of cheating; treat it as information to look into.

6. Availability, pilot status, and changes

  • TypeWriter is currently in pilot. It is provided as is, with no uptime or availability commitment.
  • We may change, suspend, or discontinue features. For a change that materially reduces functionality a district relies on, we will give reasonable notice.
  • Keep your own copies of anything you cannot afford to lose. Export tools are built in for exactly this reason.

7. Fees

TypeWriter is free during the pilot. If we introduce fees we will give notice before they apply to you, and you may decline by discontinuing use.

8. Termination

  • You may stop using TypeWriter at any time and delete your account from within the product.
  • We may suspend or terminate an account that breaches these Terms, or where required by law.
  • On termination we delete your data as described in the Privacy Policy. Export first — deletion is permanent.

9. Disclaimers and limitation of liability

TypeWriter is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss of goodwill.

Nothing here limits liability that cannot be limited by law.

10. Indemnity

You agree to indemnify and hold TypeWriter harmless from any claim arising out of your violation of these Terms — including publishing content in the community repository that you do not have the right to share, or entering a student's personal information in violation of Section 4.

11. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. Any dispute arising under these Terms will be brought in the state or federal courts located in Illinois, and each party consents to personal jurisdiction there.

Where your district has signed an agreement with us, that agreement's governing law applies to it, not this one. A signed data privacy agreement is normally governed by the law of the district's own state, and it takes precedence over these Terms. See Section 1.

12. Miscellaneous

  • Entire agreement, subject to any signed district agreement, which controls.
  • Severability: if a provision is unenforceable, the rest stands.
  • No waiver by delay in enforcing.
  • Assignment: you may not assign these Terms without our consent; we may assign in connection with a merger or sale of assets.
  • Changes: we will post an updated date and notify account holders by email of material changes.
